Welcome to Mark Twain AI ("marktwain.io," "we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using Mark Twain AI, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Description of Service

Mark Twain AI is a web application that generates text in the style of Mark Twain using artificial intelligence. Users can request Twain-style writing across four distinct periods of his life, receive automatic period suggestions, and regenerate outputs as desired.

3. User Accounts

To use our generation features, you must create an account through our authentication provider (Clerk). You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and promptly update any changes.

4. Free Tier and Usage Limits

We currently offer a free tier with the following limitations:

  • 5 text generations per user per day
  • Usage resets at midnight UTC

We reserve the right to modify these limits, introduce paid tiers, or change pricing at any time with reasonable notice.

5. Acceptable Use

You agree not to use Mark Twain AI to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity, or falsely represent your affiliation
  • Attempt to circumvent rate limits or other technical restrictions
  • Interfere with or disrupt the service or servers
  • Use automated means to access the service beyond normal usage
  • Violate any applicable laws or regulations

6. Intellectual Property

Generated Content: Text generated by Mark Twain AI is provided for your personal and commercial use. You own the rights to the specific outputs generated for you. However, similar or identical outputs may be generated for other users.

Mark Twain Works: The original writings of Mark Twain that inform our AI are in the public domain. Our service adds no new restrictions to public domain materials.

Our Service: The Mark Twain AI service, including its design, code, prompts, and branding, is owned by us and protected by intellectual property laws.

7. AI-Generated Content Disclaimer

Content generated by Mark Twain AI is created by artificial intelligence and may:

  • Contain inaccuracies or anachronisms
  • Not perfectly replicate Mark Twain's actual writing style
  • Produce unexpected or unintended results

You are solely responsible for reviewing and using generated content appropriately. We do not guarantee the accuracy, quality, or suitability of any generated text.

8. Disclaimer of Warranties

MARK TWAIN AI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

You agree to indemnify and hold harmless Mark Twain AI and its operators from any claims, damages, losses, or expenses arising from your use of the service, your violation of these Terms, or your violation of any rights of another party.

11. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue the service at any time without notice. We may also update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to the service at any time, with or without cause, with or without notice. Upon termination, your right to use the service ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
